Who is entitled to overtime pay

Part IV of the Employment Act, which governs hours of work and overtime, covers a non-workman earning a basic monthly salary of S$2,600 or less, and a workman earning S$4,500 or less. Managers and executives are not covered at all.

Above those thresholds there is no statutory overtime entitlement. Anything paid is contractual, which means it is whatever the employment agreement says and no more.

MOM's hourly basic rate formula

For a monthly-rated employee, the hourly basic rate is twelve times the monthly basic salary, divided by fifty-two times forty-four. The forty-four is the standard weekly hours figure the Act uses, not the hours a particular employee happens to work.

Overtime is then that hourly rate multiplied by at least 1.5, times the overtime hours. There is one wrinkle worth knowing: for a non-workman, the overtime rate is computed on a salary capped at S$2,600, so a covered non-workman earning close to the threshold does not get a proportionally higher overtime rate.

The limits that bite

An employee may not work more than 72 hours of overtime in a month without an exemption from MOM. Overtime pay must reach the employee within 14 days of the end of the salary period.

Both are commonly missed by businesses tracking overtime on paper or in a spreadsheet, because nothing in a spreadsheet objects when a month quietly passes 72 hours.
